CONFIDENTIALITY STATEMENT
Library ethical rules state that it is a basic right of every individual to read what he or she wishes without fear of censure or legal consequences. Each person also has the right to privacy. The Scotch Plains Library will protect each user’s right to privacy with respect to all information required for registration, for all information sought and received, and for materials consulted, borrowed or acquired. Such records will not be made available to any individual, organization or government agency except pursuant to Education Code 18A:73-43:2, and under the authority of, and pursuant to, federal, state or local law relating to civil, criminal or administrative discovery procedures and with proper mandated paperwork.

Library records which contain the names or other personally identifying details regarding users of libraries are confidential and shall not be disclosed except in the following circumstances:
a. The records are necessary for the proper operation of the library;
b. Disclosure is requested by the user; or
c. Disclosure is required by pursuant to a subpoena issued by a court or court order.

All staff of the Scotch Plains Public Library will receive notice of and instruction in proper procedures to be followed in the event of a legal request from local, state or federal authorities.
